1. Use of the Planitfitnessdirect.co.uk web site

The Planitfitnessdirect.co.uk web site is provided to you free of charge for your personal use subject to these Terms and Conditions. By using the Planitfitnessdirect.co.uk web site you agree to be bound by these Terms and Conditions.

3. Pricing / VAT

All products listed in our Retail Shop are priced inclusive of VAT. All prices quoted are correct at time of going to press, and supersede any previous prices. Due to circumstances beyond our control these may change, including rate of Value Added Tax. The price levied will be confirmed at the time of ordering.

Credit/Debit Card - most cards accepted. Cheque – items purchased will only be dispatched on cheque clearance.

7. Returns and shortages policy

Before signing for your goods, please ensure you check the outer packaging. If there is noticeable damage to any part of the packaging, please sign the delivery note accordingly. We cannot accept claims for goods damaged in transit if you have not indicated damage on the delivery note. Any damages, defects or shortages must be notified in writing via e-mail within 72 hours of receipt of goods to: customerservice@planitfitnessdirect.co.uk

Any customer refusing delivery of goods for any reason other than goods damaged in transit will be responsible for all delivery costs and the return to our warehouse costs. There will also be a minimum15% restocking charge.

Planit Fitness Direct can not be held responsible for any shortages, damages or defects notified to us after 72 hours from delivery. Please note: COURIERS WILL NOT COLLECT ANY UNPACKAGED GOODS. All order cancellations or returns must be notified to us by e-mail only. If you wish to cancel or return goods please e-mail customerservice@planitfitnessdirect.co.uk and we will issue a Return Product Authorisation (RPA). Goods must be returned to us within 7 days of receipt of RPA. No returns will be accepted after 30 days from delivery of goods. Incorrect/Faulty goods must be returned to us before replacements will be dispatched. Refunds will be made in the original payment method and within 14 days of our receipt of goods. All refunds must be authorised by our staff.

8. International Products Warranty

All goods are covered by the manufactures specific warranties and subject to the use and maintenance terms therein. The normal guarantee can only be given where equipment or merchandise is used for its intended usage and design environment. Warranties will be invalidated if damage to the equipment or merchandise is considered by the company or manufacturer to have been caused by misuse, abuse, neglect or through an absence or insufficient application of recommended maintenance. For piracy reasons Software, videos, DVD and Audio Media products cannot be returned for credit once the packaging has been opened unless a manufacturing fault has been experienced. For hygiene reasons POWERbreathe, other respiratory products and mats cannot be returned for credit once the packaging has been opened unless a manufacturing fault has been experienced.

9. Cancelations

Under the Consumer Protection (Distance Selling) Regulations 2000 you have a statutory right to cancel your order and receive a full refund within 30 days of receipt of your products. The cost of postage, packaging and insurance to return the goods will be borne by the customer and goods must be received by us in perfect condition and in their original packaging for resale. The cost of delivering the goods will be deducted from any refund. There may be a re-stocking charge. If goods are not received back in perfect condition and in their original packaging, Planit Fitness reserve the right not to accept the goods at our warehouse and/or not to issue a refund or credit. Any costs to redeliver the goods will be payable in advance by the customer. If the goods have been removed from their original packaging or assembled, your right to cancel may be forfeited. Our Standard 30 day online return option applies to goods purchased for domestic use only. This option does not apply to equipment purchased for commercial use or for any ‘special order’ items. Due to hygiene and piracy, Nutritional Supplements, mats, software, DVDs, videos and books do not qualify for our ’30 day return policy’. All order cancellations or returns must be notified to us by e-mail only. If you wish to cancel or return goods please e-mail customerservice@planitfitnessdirect.co.uk and we will issue a Return Product Authorisation (RPA). Goods must be returned to us within 7 days of receipt of RPA. No cancellation of order will be accepted after 30 days from delivery of goods.

10. Complaints

Planit Fitness sincerely hopes you never have reason to complain, but should the need arise; we will always endeavour to resolve your grievance quickly and amicably. If you do need to complain then please e-mail customerservice@planitfitnessdirect.co.uk

11. Data protection

All customer information will be treated under the terms of the Data Protection Act 1998. We will not forward your details to other companies or agents. We may identify and inform you of other products and services offered by Planit Fitness which may be of interest to you. You may opt out of this newsletter at any time by e-mailing customerservice@planitfitnessdirect.co.uk

12. Waste Electrical and Electronic Equipment

Under new European Union legislation each EU Member State now has a legal obligation to minimise the disposal of WEEE in landfill sites. Electrical and Electronic Equipment that was manufactured after 13th August 2005 should display the crossed-out wheelie bin symbol. The purpose of the symbol is to encourage householders to dispose of their WEEE separately from household waste. The content of hazardous components in electrical and electronic equipment (EEE) is a major health concern for humans and the environment during the waste management and recycling phases. Please contact your Local authority who often provide a collection and disposal service free of charge for bulky electrical items.

13. Customer Registration

To register with www.planitfitnessdirect.co.uk you must be eighteen years of age, ensure all personal details provided are correct and inform us immediately of any change to the information provided by updating your personal details / account.

14. Disclaimer

Although Planit Fitness Direct endeavour’s to keep all product information on our web-site and brochures current, occasionally, product specifications may change without notice, items may be mis-priced and typo-graphical errors may occur, we will not be held responsible for such errors and/or omissions. If a pricing error is discovered, Planit Fitness Direct, after contacting you, will either; continue with your order at the amended price or cancel the order if requested. We will not be obliged to supply goods at the incorrect price. All orders made by you through the Website are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances. After submitting an order to us we will send you an order acknowledgement email with your order number and details of the goods that you have ordered. Please note this email is an acknowledgement and is not an acceptance of your order. Any email or other electronic acknowledgement by us of receipt of an order placed by you does not constitute legal acceptance by us of your order. Whilst every care has been taken to ensure that this website is virus-free, Planit Fitness Direct accepts no liability for viruses or virus damage as a result of using this website. The terms of the contract do not affect your statutory rights.

15. Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Northern Ireland (United Kingdom) and any disputes will be decided only by the Courts of Northern Ireland.
